Well, around the world, many are frustrated by the high cost of obtaining legal certainty in dispute resolution. This is compounded by the relatively long time it takes to resolve. Indeed, there is no problem without a solution. There are times, however, when the rules make things more complicated. Mediation has become the preferred method of dispute resolution. Mediation is more private, flexible, and assisted by trained professionals in reaching an agreement. This is helpful, beneficial, and acceptable to both parties to the dispute and no one feels like they have lost or won through mediation.
There are cases that cannot be mediated, but in civil cases, most issues can be mediated. Basically, the will and regulations on mediation need to increase significantly so that everyone can use it properly. This is what I am focusing on in 2022. I can say that this is one of my proudest achievements this year and it has challenged me and taught me the greatest lessons. Why the greatest lesson? Why a challenge?
It seems to me that by definition, a challenge is an endeavor that aims to arouse your abilities, and completing it is a success. At the beginning, I saw a lot of ineffective dispute resolution. The length of time it takes to resolve simple disputes can be attributed to simple issues that should be resolved quickly. This gave rise to my determination to be able to focus on that quiet space.
Based on the dispute data provided to me this year, there were 12 disputes. My involvement in these 12 cases ultimately resulted in 7 disputes being successfully resolved using mediation methods. A total of five disputes ended in failure due to the parties not wanting to attend the mediation meeting any longer. Mediation probably ranks among the quickest, most flexible, and most effective options for resolving disputes due to its high success rate.
From my experience assisting people in resolving their disputes, I have learned one big lesson. In other words, it is to never be selfish because selfishness closes opportunities, selfishness eliminates common sense, and selfishness creates conflicts.
Throughout the year 2022, there were several disputes in the private sphere, including disputes about husbands and wives, inheritances, and ownership of valuable objects. These disputes demonstrate how close relationships once were, but then grew distant. Despite the fact that they used to uphold brotherhood, they are now at odds for personal gain. While closeness, brotherhood, and relationships are valuable assets in resolving a dispute.
Having been able to resolve my dispute through mediation this year gave me the satisfaction of finally being able to overcome the challenges I mentioned previously. I made optimal use of my abilities, even though some of my failures still stung my heart. Understanding that it will be far easier to resolve disputes if it is done with high self-awareness, the ability to accept differences, and listening carefully without judgment.
I hope that in the coming year I will be able to achieve better success. Knowing my limits, and knowing some of my shortcomings, was a big lesson for me this first year. Congratulations to me for what I have accomplished. May this experience be a great lesson for 2023.
