One of the 'common laws' is that a contract can't be forced upon you and remain valid.
Threat, duress, and coercion invalidate any contractual obligations.
Leaving aside the reality that we can't 'be' in a fiction, we are led to believe that we live in a republic, this aspect of 'the law' (freely given, fully informed consent) should be sacrosanct in a republic.
